Definitions

- "You": The user accessing or using the Service.
- "Service": Refers to TeraTalker and its offerings, including access to various AI language models.
- "Website": Refers to TeraTalker.
- "Model": An AI language model available through the Service.
- "Free Account": A user account with limited access and query capabilities.
- "Premium Account": A user account with enhanced features and higher query limits, subject to a monthly fee.
- "Queries": Requests or interactions made by users with the models through the Service.
- "Tokens": The units used to measure the complexity and length of queries.

1. Acceptance of Terms

By accessing or using TeraTalker ("Service"), you agree to be bound bythese Terms and Conditions ("Terms"). If you disagree with any part of the Terms, you may not access the Service.

2. Service Description

2.1. TeraTalker provides an AI-powered conversation and task completion service that allows users to interact with various Large Language Models (LLMs).

2.2. Available Models: The Service offers access to the following models:

The availability of specific models may change without notice.

2.3. By using any model, you agree to comply with its specific terms and conditions in addition to these Terms.

3. Account Types and Usage Limits

3.1. Free Account: Limited to 20 queries per calendar month.

3.2. Premium Account: Priced at €9 Euro per month, allowing up to 1500 queries per calendar month.

3.3. The 1500 queries for Premium accounts correspond to approximately 4.5 million tokens. Actual usage may vary based on query complexity and the specific model used.

3.4. Unused queries do not roll over to the next month.

4. User Accounts

4.1. You must create an account to access the Service.

4.2. You are responsible for maintaining the confidentiality of your account and password.

4.3. You agree to provide accurate and complete registration information.

5. Payments and Cancellation

5.1. Premium account fees are billed monthly at €9 Euro.

5.2. Payments are non-refundable. No refunds or credits will be provided for partial use.

5.3. You may cancel your Premium subscription at any time, effective at the end of the current billing cycle.

6. Acceptable Use

6.1. You agree not to use the Service for any unlawful or prohibited purpose.

6.2. You may not attempt to gain unauthorized access to the Service or its related systems.

6.3. You may not use the Service to generate, upload, or share harmful, inappropriate, or illegal content.

7. Intellectual Property

7.1. All content generated through the Service is owned by TeraTalker.

7.2. Users are granted a limited, non-exclusive license to use the generated content for personal or internal business purposes.

8. Privacy and Data Usage

8.1. Our Privacy Policy governs the use of your personal information and is incorporated into these Terms by reference.

8.2. Your interactions with the models may be used to improve the Service and the underlying models, subject to our Privacy Policy and model-specific data usage policies.

9. Modifications to the Service

9.1. We reserve the right to modify or discontinue the Service at any time without notice.

9.2. We may update these Terms from time to time. Continued use of the Service constitutes acceptance of any changes.

10. Disclaimer of Warranties

10.1. The Service isprovided "as is" without any warranties, express or implied.

10.2. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, TeraTalker shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

12. Third-Party Model Providers

12.1. TeraTalker integrates models from various third-party providers. We do not own or control these models.

12.2. We are not responsible for the content generated by these models or changes in their availability or functionality.

12.3. Users agree to comply with any additional terms imposed by the third-party model providers.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.
